TERMS AND CONDITIOS OF USE.

TangoMail.net (“The Service” or “TangoMail”) is a web based email marketing service focused on providing companies, organizations and individuals with tools and resources focused on delivering timely and useful information to people through their email addresses, which can be collected, organized and segmented by using the service.

The following are TangoMail.net’s terms and conditions for use. By logging in for the first time, you accept these terms and conditions, becoming an understood agreement between you (“The User”) and TangoMail.net. This agreement may be updated by TangoMail.net as needed, being the new version always available at TangoMail.net’s website.

1. About the service.

1.1 The service is provided as is. Even though feedback is always welcome through our contact form, and many of our clients’ good ideas are taken into consideration, TangoMail.net is not obligated to make any change to the service. Under this same premise, you understand that HTML newsletters designed and delivered by TangoMail.net may not be experienced in identical manner by all email software or services.

1.2 Image Storage Space. TangoMail.net provides 1 MB of image storage space per account. This space is provided exclusively to be used with TangoMail.net’s email service, and done so without any warranty of availability in a far or near future. If an account is terminated by either party, all data, including image stored will be destroyed.

1.3 Fees. TangoMail.net’s fees are always visible and available at http://www.tangomail.net/pricing. Clients can upgrade their accounts at any time through TangoMail.net’s Website. By accepting these terms, you authorize TangoMail.net to bill and charge in advance to your credit card in accordance with the service or services you desire. All fees paid to TangoMail.net are non-refundable, unless account is terminated by TangoMail for a reason other than violation of the Anti-Spam Policy. All fees are subject to revision and change by TangoMail.net at any time. By continuing the use of TangoMail.net you accept these charge. If your credit card can’t be charged, your account will be suspended until payment is received through a valid credit card.

2. Restrictions and Responsibilities

2.1 This is an Agreement for Services, and you are not granted a license to any software by this Agreement. You will not, directly or indirectly: reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, or algorithms of, or found at or through the Services or any software, documentation, or data related to the Services ("Software"); remove any proprietary notices or labels from the Services or any Software, modify, translate, or create derivative works based on the Services or any Software; or copy, distribute, pledge, assign, or otherwise transfer or encumber rights to the Services or any Software. If you are using the Services in any country in the European Community, the prohibition against modifying, translating, reverse engineering, decompiling, disassembling or creating derivative works based on the Services or the Software does not affect your rights under any legislation implementing the E.C. Council Directive on the Legal Protection of Computer Programs.

2.2 You agree to use TangoMail.net as it was designed to be used and only using the tools willfully provided by TangoMail.net to you as described in our Pricing and Features page in TangoMail.net’s WebSite. This means that any other use of TangoMail.net, its servers, technology, brand, logo or information of any kind is prohibited.

2.3 You hereby agree to indemnify TangoMail.net against any damages, losses, liabilities, settlements, and legal expenses connected with any claim or action that arises from an alleged violation of this agreement.

2.4 TangoMail.net cannot be used by you to collect, promote or distribute in any way information related to prostitution, pornography, hate, racism, violence, terrorism or any other matter that may be considered immoral or illegal.

2.5 TangoMail.net will never share your information or the information of your contacts with anyone, being the only exception to be considered the lawfully request by a Court of Law.

3. Termination

3.1 You may terminate this Agreement at any time by contacting TangoMail.net by sending an email to info@tangomail.net with your user, password and explicit request. No refunds will be issued if you terminate this agreement.

3.2 TangoMail.net may terminate this agreement at any time, refunding you for any pending period of time previously paid by yourself to TangoMail.net. After termination of agreement, you will be granted access to your account and data for 30 days, after which all information will be destroyed. TangoMail.net will not be responsible for any loss of data at any time.

4. Warranty Disclaimer

USE OF THE SERVICES AND ANY RELIANCE BY YOU UPON THE SERVICES, INCLUDING ANY ACTION TAKEN BY YOU BECAUSE OF SUCH USE OR RELIANCE, IS AT YOUR SOLE RISK. TANGOMAIL.NET DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES. THE SERVICES ARE PROVIDED "AS IS" AND TANGOMAIL.NET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. TANGOMAIL.NET WILL NEVER BE HELD RESPONSIBLE OR ACCOUNTABLE FOR ANY LOSS OF INFORMATION, SYSTEM FAILURE OR ANY OTHER DAMAGE THAT MAY ARISE DIRECTLY OR INDIRECTLY TO YOU OR YOUR CONTACTS. YOU ASSUME RESPONSIBILITY FOR ADEQUATE CARE OF YOUR USER AND PASSWORD INFORMATION AND FOR ANY UN DESIRED OUTCOME OF TANGOMAIL.NET’S USE.
